Hotel Complaints and Non-Disclosure Agreements (NDAs)
Let’s say your hotel stay has been less than stellar.
In fact, it’s so bad you decide to complain. In the past, depending on the situation, hotels might waive charges or offer a complimentary stay. However, a growing trend sees hotels requiring guests to sign a non-disclosure agreement (NDA) when offering complimentary stays or cash compensation in response to service, quality, or design issues.
Is this fair, legal, or enforceable? No guest should have to hire a lawyer to accept compensation for a hotel’s mistakes.
Here’s my advice: Unless the compensation is offered as part of a lawsuit settlement with a NDA included, never agree to an NDA for nominal cash or a free stay. Make it part of your negotiation.
